The Grant of Probate is the formal confirmation that the executor has the legal right to manage and distribute the deceased person’s estate.
If the owner died and the property was solely owned, personal representatives must obtain the Grant before they can exchange contracts, transfer ownership at the Land Registry, distribute remaining funds, and settle outstanding debts.
If there’s no will, administrators apply under intestacy rules. In both cases, probate is part of the legal process that protects beneficiaries and ensures estate administration is handled properly.
Until probate is granted, you do not have full legal authority to complete the sale.
